$12,500,000 Jury Verdict
Steve Wagner obtained a $12,500,000 jury verdict against the New York City Transit Authority in New York State Supreme Court, Kings County, following a nearly three week long damages-only trial on behalf of a referral partner and their client.
The jury allowed for $4,300,000 in past pain and suffering, $8,000,000 in future pain and suffering, and $200,000 in future medical costs.
The defendant bus operator failed to put on the air brakes after parking a NYCTA bus. The bus rolled backwards and crashed into the plaintiff’s car, which then hit the plaintiff-pedestrian.
The plaintiff was 27-years-old at the time. After nearly two years of severe back pain and failed conservative treatment, he underwent a one-level lumbar fusion surgery due to a herniated intervertebral disc.
The plaintiff withdrew his lost earnings claim and claims of injuries to other body parts that had healed.
Mr. Wagner countered the defendants’ arguments about degeneration and obesity by showing the plaintiff never had prior back trauma and was working full-time with no back-related problems before the crash.

About Steve Wagner
Steve Wagner has obtained 7-figure and 8-figure damages jury verdicts. He has secured tens of millions of dollars in settlements and verdicts during his career. He is passionate about plaintiff’s trial work and believes strongly in the awesome power of jurors to find justice for their neighbors.
Before launching Wagner Trial Law PLLC, Steve Wagner worked as a trial lawyer at several renowned personal injury law firms based in New York City for over a decade.
Steve Wagner has chiefly prosecuted Labor Law cases, which are construction incidents where laborers are catastrophically injured due to workplace hazards and safety violations. He has also tried municipal liability cases, premises trip/slip and fall cases, and motor vehicle crash cases across the NYC region. Additionally, he has prosecuted medical malpractice and nursing home neglect cases.
Steve Wagner graduated from Duke University School of Law. Prior to attending Duke, he studied Mandarin Chinese on a full scholarship at Zhejiang University in Hangzhou, China. He graduated magna cum laude with a Bachelor's Degree in History from Boston College.
He lives in Brooklyn, NY with his wife and two children.
